Στο Συμβούλιο της Επικρατείας προσέφυγε ο Δικηγορικός Σύλλογος Θεσσαλονίκης, ζητώντας την ακύρωση του υπ. αρ. 50/2025 Προεδρικού Διατάγματος, το οποίο αφορά στο νέο Κανονισμό λειτουργίας του Αρείου Πάγου, καθώς, όπως υποστηρίζεται στην αίτηση, είναι αντισυνταγματικός και αντίθετος στην Ευρωπαϊκή Σύμβαση Δικαιωμάτων του Ανθρώπου (ΕΣΔΑ).
Ειδικότερα, η προσφυγή του ΔΣΘ επικεντρώνεται στην αντισυνταγματικότητα του νέου Κανονισμού, στις διατάξεις εκείνες που προβλέπουν ότι:
α) Ο αριθμός των σελίδων των εισαγωγικών δικογράφων (αιτήσεις αναιρέσεως κλπ), επί των αστικών υποθέσεων που κατατίθενται από την 15η Σεπτεμβρίου 2025 (νέο δικαστικό έτος), δεν πρέπει να υπερβαίνει τις 30 σελίδες, των προσθέτων αυτών λόγων τις 20 σελίδες, των προτάσεων και των υπομνημάτων τις 10 σελίδες, όσον αφορά δε στις αιτήσεις αναστολής (άρθρο 565 Κ.Πολ.Δ.), τις 5 σελίδες και β) ο χρόνος αγορεύσεων δεν μπορεί να υπερβαίνει τα 6 λεπτά για κάθε διάδικο μέρος, ανεξάρτητα από τον αριθμό των πληρεξουσίων δικηγόρων που το εκπροσωπούν. Όταν παρέλθει ο ανωτέρω χρόνος, η αγόρευση θεωρείται ολοκληρωμένη και ο πρόεδρος δίνει τον λόγο σε επόμενο διάδικο ή κηρύσσει το πέρας της συζητήσεως της υπόθεσης και ο χρόνος αγορεύσεων καταγράφεται με ψηφιακό χρονόμετρο, που είναι εγκατεστημένο στην αίθουσα συνεδρίασης.
1) Στο άρθρο 20 του Συντάγματος, στο οποίο αναφέρεται ότι ο καθένας έχει δικαίωμα στην παροχή έννομης προστασίας από τα δικαστήρια και το δικαίωμα της προηγούμενης ακρόασης,
2) Στο άρθρο 6 παράγραφος 1 της ΕΣΔΑ, όπου αναφέρεται ότι κάθε πρόσωπο έχει δικαίωμα όπως η υπόθεση του δικασθεί δικαίως, δημοσία και εντός λογικής προθεσμίας υπό ανεξαρτήτου και αμερολήπτου δικαστηρίου και
3) Στην αρχή της ισότητας των διαδίκων καθώς περιαγάγει σε πλεονεκτικότερη θέση τον αναιρεσείοντα ο οποίος έχει να αναπτύξει της απόψεις του μέσα σε 30 σελίδες, ενώ ο αναιρεσίβλητος έχει τη δυνατότητα να αναπτύξει την υπεράσπισή του μέσα σε 10 σελίδες.
